FSCM Legislative Update

February 5, 2009
Luke Montgomery, secretary of the Financial Service Centers of Mississippi Association (FSCM) sent an e-mail update February 5, 2009 to members concerning the bills that the association has been monitoring.

In the e-mail, he states, “all bills pertaining to our industry, including the alternative rate bill, died in committee on Tuesday. We do not foresee anything else coming up this session that would negatively impact our industry.

However, Chairman George Flaggs mentioned in the committee meeting that a study on consumer finance in the state of Mississippi would be performed by the Wagner School for Public Service in New York. We do not have any information on this study as of now but will update you as things transpire.”

As proposed, the bill entitled, “Protecting Consumers from Unreasonable Credit Rates Act of 2008”, would amend the truth and lending act and set a federal usury cap of 36 percent APR on all consumer credit transactions, including all interest, fees, defaults and insurances as finance charges.
